Question: Can I bring Medicinal Marijuana to Canada When Visiting?

This series of articles address recurring legal questions that our attorneys are often confronted with at social gatherings, and by inquisitive family members and friends. Often these topics are seemingly trivial, relating to obscure topics, usually asked in good fun; other times they are quite serious, with the possibility of truly calamitous, and perhaps unforeseen, consequences. In this short series we will address some of the questions and attempt to shed a little bit of light on them.


I am legally allowed to possess and use marijuana for medical purposes and will be travelling to Canada, am I allowed to transport it?


The short answer is: No. It does not matter whether you are lawfully allowed to possess marijuana for medical reasons, or whether you are a resident of a state that allows for the possession of marijuana for recreational purposes, you cannot bring it in.


Although as of October 17, 2018, subject to provincial or territorial restrictions, adults who are 18 years of age or older are legally able to possess up to 30 grams of legal cannabis, and buy dried or fresh cannabis and cannabis oil from a provincially-licensed retailer, if you attempt to bring marijuana across the border you can be charged with drug trafficking, face a prison sentence of up to 14 years, and forever be barred from entering Canada. It would appear that if you have a prescription for medicinal marijuana from the United States, your prescription should be honored by Canadian purveyors of medicinal marijuana.
