Do you have a claim?
Following a car accident you may be questioning whether you have a right to file a claim. In order to be able to file a claim to collect for damages your accident must have been:
  • Caused by another person's negligence; and,
  • You and/or a family member were seriously hurt in that accident.

What to do immediately following an accident
  • Do not leave the scene. Illinois law requires that you remain at the scene of an accident.
  • If you are in pain, remain in your vehicle if the situation permits it and it is not dangerous to do so. Alert any person present that you are injured and in pain.
  • Contact the police for help. You will need to file a police report and explain how the accident occurred.
  • Leave your vehicle where it is unless it is blocking traffic or it is dangerous to do so.
  • If you are able, take photographs of the damage to all of the vehicles involved as well as of the scene.
  • If you are injured go to the hospital immediately. If it is necessary request that an ambulance take you to the emergency room. Make sure to follow your doctor's recommendations and to follow up with your doctor as necessary.
  • Contact your insurance company and advise them of the accident.
  • If you are contacted by the other party's insurance company do not speak with them until after you have spoken with an attorney. Your desire to speak with the other party's insurer may be from a good faith desire to explain your side of the story and show that you were not at fault, but you must understand that the other party's insurance company is already working to minimize their liability and your claim. In other words, they are working hard to build their defense against your claim. You must be aware that even your innocent comments can be manipulated and used against you. That is why the best way to protect your interests and rights is to work through your attorney when dealing with the other party's insurer.
